An omiso is a tax return you were required to file but did not file. The problem is what it blocks: a solvencia fiscal (tax clearance certificate) and printing your tarjeta de circulación (vehicle circulation card) in Agencia Virtual, SAT’s online taxpayer account. This guide follows SAT’s own frequently asked questions.
Quick summary: SAT groups omisos under Omisos in Consulta de Incumplimiento (the non-compliance check): «Omisiones de declaraciones de impuestos» [omitted tax returns]. There are three official ways to check: Consulta de Incumplimiento in Agencia Virtual, Verificador Integrado (the integrated checker) on the SAT portal, and Declaraguate form SAT-8421, which displays omissions when you request tax clearance. With omisos, you cannot obtain tax clearance. Although you can complete vehicle procedures, you cannot print the circulation card or ownership certificate online. Clear omissions by filing the return and paying the applicable amount; once resolved, they stop appearing.
What an omiso means, according to SAT
SAT’s Agencia Virtual includes Consulta de Incumplimiento, which «permite verificar de forma práctica y oportuna, los distintos tipos de incumplimientos que un contribuyente tiene ante la SAT» [allows taxpayers to check their different types of non-compliance with SAT in a practical, timely way]. Omisos are one of 11 types it displays. (SAT tax-compliance FAQ)
| Component | What it includes |
|---|---|
| RTU Digital (digital taxpayer register) | NIT not updated or ratified; outdated tax address or legal representative; no IVA registration; no authorization of accounting books |
| FEL (electronic invoicing) | Taxpayer reluctant to join electronic invoicing |
| Exoneraciones (penalty relief) | Unpaid penalties associated with relief granted by the Presidency |
| Omisos | Omitted tax returns |
| Vehículos (vehicles) | Arrears in Impuesto sobre Circulación de Vehículos (ISCV, vehicle circulation tax) |
| Convenios de Pago (payment agreements) | Overdue installments |
| Cumplimiento Tributario (tax compliance) | Control cases arising from detected inconsistencies |
| FISEL | Penalties for breaches of formal duties arising from tax inspection visits |
| Proceso Administrativo (administrative proceedings) | Audit-adjustment cases at the hearing or decision stage |
| Regímenes Temporales (temporary regimes) | Temporary imports whose permitted period has expired |
| Proceso Económico Coactivo (compulsory collection proceedings) | Tax cases in compulsory collection, handled by the Intendencia de Asuntos Jurídicos (legal affairs office) |
This table helps you read the results: not everything shown in red is an omiso. An outdated NIT is an RTU compliance issue, not an omitted return, and requires a different solution.
How to check for omisos: the three official routes
1. Consulta de Incumplimiento (Agencia Virtual)
This displays all 11 components. SAT gives this menu path:
Agencia Virtual > Servicios al Contribuyente > Cuenta Corriente > Consulta de Incumplimiento
The menu labels mean taxpayer services, current account and non-compliance check. The tool displays each outstanding item «con valores numéricos e íconos en color rojo» [with numerical values and red icons]. When none exists, the icons are blue with a zero value. All blue icons with zero values mean SAT has identified no non-compliance. The IMPRIMIR (print) button generates an individual or general PDF report. The tool is available to all taxpayers with Agencia Virtual; if you do not have access yet, see how to register for Agencia Virtual.
2. Verificador Integrado (SAT portal)
Asked whether this tool can check omisos, SAT answers: «Sí, a través del Verificador Integrado, se puede establecer la omisión de presentación de declaraciones tributarias ante la SAT» [yes, the integrated checker can identify tax returns not filed with SAT]. Besides omissions, it shows data updates, authorization of books, reluctance to join FEL and cases with the Intendencia de Asuntos Jurídicos. It is also the check SAT recommends to notaries to establish whether a vehicle seller or buyer has omissions. (SAT taxpayer-information FAQ; SAT vehicle FAQ)
3. Form SAT-8421 (when requesting tax clearance)
If you need a solvencia fiscal, the form itself alerts you. SAT states: «Previo a realizar tu pago, en Declaraguate- Formulario SAT 8421, el sistema despliega las omisiones y obligaciones pendientes» [before payment, Declaraguate form SAT 8421 displays omissions and outstanding obligations]. This lets you find out before paying Q30. (SAT tax-compliance FAQ)
What an omiso blocks
| Procedure | What happens with omisos | Source |
|---|---|---|
| Solvencia fiscal | Not issued with omissions and outstanding obligations | SAT tax-compliance FAQ |
| Tax clearance already paid for | If you paid Q30 and omissions appeared: pay the outstanding amounts, wait 24 hours, apply again and verify that no obligations remain. Pay for a new certificate if the system says it will be issued immediately | SAT tax-compliance FAQ |
| Vehicle procedures | Can be completed with IVA, ISR or ISO omissions, but you cannot print the electronic circulation card or ownership certificate in Agencia Virtual until they are resolved | SAT vehicle FAQ |
| Vehicle transfer | When the electronic forms are completed, an alert tells the notary whether the buyer has vehicle-related omissions | SAT vehicle FAQ |
For the circulation card, SAT says that to print the ownership certificate or circulation card in Agencia Virtual, «debes estar al día en el pago del ISCV, no tener omisos del IVA, ISO u otro que corresponda» [you must be current on ISCV payments and have no omissions for IVA, ISO or any other applicable tax]. If that is your immediate concern, see vehicle circulation card. (SAT vehicle FAQ)
For tax clearance, SAT lists a cost of Q30 and a processing time of 3 business days, counted from the day after payment. See the full solvencia fiscal procedure. (SAT tax-compliance FAQ)
How to clear omisos
1. File the missing return and pay the applicable amount. SAT says that once an omitted tax is paid or the non-compliance is resolved, it stops appearing in Consulta de Incumplimiento. For issues other than FISEL penalties, SAT states: «Para otros incumplimientos, utiliza Declaraguate o acude a una Agencia u Oficina Tributaria» [for other non-compliance, use Declaraguate or visit a tax agency or office]. See Declaraguate for using the forms.
2. If it is an RTU issue, update it. SAT says that updating or ratifying RTU data also removes that non-compliance item. See updating your RTU.
3. For a FISEL inspection penalty, prompt payment brings a reduction. Use Recibo SAT-0860, the payment receipt you generate yourself in Agencia Virtual, through Consulta de Incumplimiento or Generar Recibo (generate receipt), then pay at the bank. SAT states: «tienes una rebaja del 80% si realizas el pago dentro de los siguientes 5 días hábiles a partir de la suscripción del acta donde consta la infracción» [you receive an 80% reduction if you pay within the following 5 business days from the signing of the record documenting the violation]. You can still pay after that period, but without the reduction. The audit department must also validate the payment before this item disappears. (SAT tax-compliance FAQ)
4. If you cannot pay everything at once, ask about a facilidad de pago (payment arrangement), bearing in mind the exclusions. SAT offers it under Article 40 of the Código Tributario (Tax Code), using SAT-821, for individuals or legal entities with tax debts. Its FAQ lists 10 business days for issuance in the Central Region and 5 in the other regions. Apply through the SAT portal or Agencia Virtual, which lists the documents to attach, or ask SAT’s Call Center at 1550. SAT’s FAQ excludes IVA, ISR and IVA withholdings, and ISCV. See SAT payment agreements (Spanish) for the maximum term, reductions and requirements. (SAT tax-compliance FAQ)
5. If you have an unused NIT, close the activity properly. SAT allows cese de actividades prescrito (cessation based on the prescribed inactivity period) when «su establecimiento cuenta con 4 años o más sin movimiento en su contabilidad» [your establishment has had no accounting activity for 4 years or more]. This is available in Agencia Virtual as cancelación prescrita. If your case does not meet the four-year condition, closure is definitive and has its own requirements. Only close the establishment when you are sure you will not use the business again. See closing your NIT. (SAT tax-compliance FAQ)
For foreign nationals considering cessation: SAT’s individual-business cessation requirements say you must first be ratified in RTU Digital, with a valid DPI or passport as applicable. This requirement concerns the cessation procedure. (SAT cessation requirements)
What this page cannot tell you (and why)
The exact total for your case. Article 94, item 9, of the Código Tributario sets a late-return penalty of Q50 per day, capped at Q1,000. Under Article 94 “A”, that penalty is reduced by 85% if, before being required or audited, you come forward voluntarily, accept the violation and pay immediately; the reduction does not apply if you repeat the same violation in the same tax period. That provision doubles the penalty for entities wholly or partly exempt from ISR because they carry out nonprofit activities; repeat violations also lead to definitive cancellation of their nonprofit legal-entity registration. If tax itself remains unpaid, mora (late-payment penalties, Article 92) and intereses resarcitorios (compensatory interest, Article 58) may also apply. Article 92 excludes objections, adjustments to incorrect determinations and determinations made by the tax authority, where the omitted-tax-payment penalty under Article 89 applies instead. Your total depends on the missing returns, delay and rules applicable to your case; check the amount with SAT when filing. (Código Tributario published by SAT)
