When renting an apartment in Guatemala as a foreigner, start by asking whether you can meet the particular landlord’s application requirements. A suitable apartment is only part of the decision: you also need an agreed document list, a clear breakdown of money due, and a lease you understand.

Quick summary: Published agency checklists ask for tenant and fiador documentation, income evidence and application signatures. Keep the deposit separate from advance rent and lawyer fees. If you lack a DPI or local guarantor, confirm what the landlord will accept before proceeding. Check the lease term, registration requirements and written exit notice before signing.

Start with the area and the application requirements

Use the Zone 4 rent page, Zone 10 rent page, Zone 14 rent page, Zone 15 rent page and Zone 16 rent page to begin comparing locations. Check the dates and details on each page, then request a written quote for the apartment you are considering.

Before arranging your application, ask for the landlord’s complete requirements and the proposed lease. For an English-speaking newcomer or a Guatemalan raised abroad, a useful opening question is: which identification, income documents and guarantor arrangements will you accept in my circumstances?

Documents and fiador: published agency examples

A fiador is a guarantor. Treat the following as agency-specific checklists, rather than a universal rule for every rental.

AlquiloGT: individual applicants

AlquiloGT’s FAQ lists these general rental application requirements:

  • A signed AlquiloGT rental application for an individual or company.
  • Copies of identification documents for the tenant and fiador.
  • A signed authorization letter for a credit-bureau analysis.

For an individual applicant, it additionally lists a deposit equal to the rent, advance rent, lawyer fees, employment certification and copies of the last three account statements.

Quick Real Estate: rental checklist

The rental section on Quick Real Estate’s requirements page lists:

  • Tenant and fiador DPI, with a legible signature.
  • Proof of income.
  • The first month’s rent.
  • A deposit equal to the rent.
  • Lawyer fees for the lease agreement.
  • The last three account statements for the tenant and fiador, with the qualifier guatemalteco in the agency’s wording.
  • Form FORM_QRE2 completed and signed by the tenant and fiador, using a legible pen signature rather than a digital signature.

Ask the agency to clarify that nationality qualifier and how its checklist applies to you. The same webpage has a separate financing section for foreigners; do not use that section as your rental document list.

If you have no DPI or local guarantor

Ask the landlord or agent to confirm in writing:

  • Whether your passport is acceptable for this rental and which identification details should appear in the lease.
  • Whether your employment, retirement or other income documents are acceptable, including documents issued abroad.
  • Whether a fiador is required in your case, what the fiador must provide, and whether the landlord will consider an alternative.
  • Whether any additional identification or tax documentation is requested.

Do not arrange an insurance bond or offer an extra deposit on the assumption that it automatically replaces a fiador. Obtain the landlord’s proposed terms first.

Separate the deposit, advance rent and fees

Both agency examples distinguish the deposit from rent paid at the start. Quick Real Estate expressly calls the latter the first month’s rent; AlquiloGT calls it advance rent. Both also list lawyer fees.

Item to clarifyWhat to request before paying
DepositExact amount, what it secures, permitted deductions and agreed return conditions
Advance rentThe rental period that the payment covers
Lawyer feesThe quoted amount and the work included
Other chargesAn itemized explanation and the person responsible for each payment

Ask for each item to appear separately in the written payment breakdown. Avoid describing the entire move-in payment as a deposit: that obscures which money is rent and which money is held as security.

For a furnished apartment, request an agreed inventory and document its condition before accepting it. Ask the lease to identify which utilities, building charges and repairs each party will pay. Treat these as points to settle for the particular property.

Lease basics: term, form and registration

The Civil Code text hosted by the OAS provides the following rules. They describe that edition; ask a Guatemalan notary to check later reforms and any applicable special tenancy rules before relying on them for your agreement.

Lease term. Article 1886 leaves the term to the parties. It also gives a tenant who has voluntarily fulfilled all obligations to the landlord a preferential right to renew for a new term. Agree the duration and renewal wording expressly.

Written agreement. Article 1574 includes private documents among the permitted ways to contract. Article 1575 requires writing when a contract’s value exceeds three hundred quetzales; its separate commercial-contract provision permits an oral contract when the value does not exceed one thousand quetzales. Use a written apartment lease and review it before signing.

Registration and public deed. Article 1125 provides for registration of a lease or sublease at a contracting party’s request, and compulsory registration when the term exceeds three years or rent has been prepaid for more than one year. Article 1576 requires contracts that must be registered or annotated to be made by public deed, regardless of value. It also provides that contracts remain valid, and the parties may compel execution of the public deed, if essential requirements are established through the obligated party’s judicial confession or other written proof. Do not treat a private signature or signature authentication as a substitute for checking those requirements.

Use the lease agreement template and English explanation as a starting point for reviewing the proposed agreement with your notary. Have the final identification fields and terms adapted to your situation.

Notice before leaving

Article 1939 provides for a tenant to end a housing lease with written notice to the landlord at least thirty days in advance. For business premises or offices it specifies sixty days. Both are subject to Article 1888.

That exception matters if your lease counts its duration in compulsory and optional years. Under Article 1888, the optional years become obligatory unless the party exercising the option tells the other party, three months beforehand, that the contract will end when the compulsory years finish. Ask your notary to explain how this wording interacts with your proposed end date.

Article 1941 expressly preserves the application of special tenancy legislation or emergency legislation concerning rent-setting and other conditions not determined by the preceding articles. These Civil Code provisions should therefore be read alongside the applicable special rules.

A practical sequence before committing

  • Shortlist the apartment and request the terms. Get the application requirements, proposed lease and itemized payment breakdown together.
  • Resolve your foreign-document questions. Confirm acceptable identification and income evidence, and settle the fiador question before proceeding.
  • Inspect and document the property. Ask for written agreement on its condition, any furnished inventory, repairs and included services.
  • Review the agreement. Check identification, the property description, rent, payment dates, deposit conditions, duration, renewal, exit notice and any proposed increases or penalties. Ask a notary about registration and public-deed requirements.
  • Keep the agreed record. Retain the signed agreement, payment evidence, inventory and written correspondence, including any notice you later give.

Agency requirements above are from the agencies’ rental sections read on 23 October 2026. Confirm the requirements for the property you choose. The Civil Code discussion identifies the edition and articles used; obtain advice on the rules applicable to your lease.

Frequently Asked Questions

What documents do rental agencies ask for in Guatemala?

AlquiloGT lists a signed rental application, identification copies for the tenant and fiador, a signed authorization for a credit-bureau analysis, and, for an individual applicant, employment evidence and copies of the last three account statements. Quick Real Estate has its own rental checklist, including tenant and fiador DPI, proof of income, account statements and a signed application. Ask the agency to confirm the documents it will accept from you.

Is advance rent the same as a security deposit?

Keep them separate. AlquiloGT lists a deposit equal to the rent, advance rent and lawyer fees. Quick Real Estate lists the first month’s rent, a deposit equal to the rent and lawyer fees for the lease. These are agency requirements, rather than a nationwide deposit rule.

What should I ask if I have a passport but no DPI or local fiador?

Ask whether the landlord accepts your identification, what income evidence is acceptable, and whether there is an alternative to the fiador requirement. Obtain the answer before paying or submitting an application; do not assume that financing requirements also apply to renting.

Does an apartment lease have to be registered?

The Civil Code edition linked below makes registration compulsory for leases longer than three years or when rent is prepaid for more than one year; it also provides for registration at a contracting party’s request. Registrable contracts require a public deed, subject to the evidentiary provision in Article 1576. Ask a notary to check the applicable rules for your agreement.

How much notice does a tenant give before leaving?

Civil Code Article 1939 specifies written notice at least thirty days ahead for housing and sixty days for business premises or offices, subject to Article 1888. That exception concerns leases expressed in compulsory and optional years: the optional years become binding unless the party exercising the option gives three months’ notice before the compulsory years end.
