Quick summary
- What it is: RENAP registers a stillbirth (mortinato) as its own type of inscription, with its own application form.
- Where: RENAP’s publication on stillbirth registration says the requirements apply “en cualquier oficina del RENAP” (at any RENAP office).
- Documents (per RENAP’s form): the stillbirth report, the DPI of the parents or the mother, and the filer’s DPI if a third party files.
- Deadline: 30 working days after the event, per RENAP’s publication. Thirty days is the general rule under Decreto 90-2005, Art. 84.
- Cost: free within the legal period (Art. 84). RENAP’s publication sets a late fine of Q25.00.
- Processing time: not stated on RENAP’s stillbirth form or its stillbirth service page.
This page covers only the stillbirth procedure. For a death after a live birth, see our death certificate page.
RENAP’s dedicated stillbirth form
RENAP publishes a separate form, the Solicitud de Inscripción de Mortinato (PDF on renap.gob.gt). The form is addressed to the Civil Registrar. It opens with the request “Respetuosamente solicito al Registrador Civil de las Personas, realizar Inscripción de Mortinato”. In English, that is a respectful request to the Civil Registrar to register a stillbirth using the details that follow.
The form has four sections:
| Section on the form | What it covers |
|---|---|
| 1. DATOS DEL MORTINATO | Stillbirth details. Fields include weeks of gestation (Semanas de gestación), place (Lugar del Mortinato), date (Fecha del Mortinato) and time (Hora del Mortinato) |
| 2. DATOS DE LA MADRE | Mother’s details |
| 3. DATOS DEL PADRE | Father’s details |
| 4. DATOS DEL COMPARECIENTE | Details of the person filing, including the funeral home’s name if the filer works for one (Nombre de la funeraria) |
A second form exists. RENAP also hosts a file named anexo15_solicitud_de_inscripcion_de_mortinato.pdf. We could not confirm whether it replaces the form above. Ask at the RENAP office which version they accept.
Required documents
RENAP’s stillbirth form lists these documents:
| Document | When it applies |
|---|---|
| Stillbirth report (informe de mortinato) | Always |
| DPI of the parents or of the mother | The form says “de los padres o de la madre, según el caso” (of the parents or the mother, as the case may be) |
| DPI of the person filing | The form says “si quien lo solicita es un tercero” (if a third party is requesting) |
For DPI basics, see our DPI page.
The form also cites Article 16 of RENAP Board Agreement 104-2015, the Reglamento de Inscripciones del Registro Civil de las Personas. That article lists general items required for every registration:
- RENAP’s own form, “Formulario proporcionado por el Registro Nacional de las Personas -RENAP-, en los casos de existir”. This is the stillbirth form above.
- “Comprobante de pago por concepto de inscripción extemporánea, cuando corresponda”. This means proof of payment for late registration, when it applies.
RENAP may also ask for more. Its stillbirth service page cites Article 37 of the same regulation. That article lets RENAP use complementary criteria “para requerir documentación adicional” (to require additional documentation) to help resolve applications.
Deadline and fees
| Item | Rule | Who says it |
|---|---|---|
| Stillbirth deadline | “30 días hábiles posteriores al hecho” (30 working days after the event) | RENAP’s stillbirth publication |
| General registration deadline | Registrations “se efectuarán dentro del plazo de treinta (30) días de acaecidos unos u otros” (must be made within thirty days of the event) | Decreto 90-2005, Art. 84 |
| Cost within the deadline | “Todas las inscripciones que se hagan dentro del plazo de treinta (30) días se efectuarán en forma gratuita” (free) | Decreto 90-2005, Art. 84 |
| Late fine | Q25.00 | RENAP’s stillbirth publication |
Working days or calendar days? RENAP’s stillbirth publication says working days (hábiles). Article 84 of the law says only days. The two sources do not explain the difference. Filing within 30 calendar days meets both.
Late filing is still possible. Article 84 says “En ningún caso se perderá el derecho a la inscripción”. In English: the right to registration is never lost. Past the deadline, the registration is late (extemporánea). The form’s checklist then requires proof of payment of the late fee.
Step by step
- Get the stillbirth report (informe de mortinato). It is the first document on RENAP’s checklist.
- Download and fill out RENAP’s stillbirth form (PDF). Complete all four sections.
- Bring the DPIs. You need the DPI of the parents or the mother. If someone else files, such as a relative or a funeral-home employee, bring that person’s DPI too.
- File at a RENAP office. RENAP’s publication says the procedure can be done at any RENAP office.
- If the deadline has passed, pay the Q25.00 late fine and bring the payment receipt.
What we could not confirm
These points are not settled by the RENAP sources we reviewed. Each line says which source is silent:
- Processing time. Neither RENAP’s stillbirth form nor its stillbirth service page says how long processing takes.
- Price of a certified copy. We did not verify a stillbirth-specific price for a certified copy. Do not assume ordinary death-certificate prices apply.
- Burial document. The form covers the registration. It does not say which burial document is issued or how it is collected.
- Birth and death registration. The dedicated form and service page do not tell families to register a stillbirth as both a birth and a death. The form treats it as one inscription type.
- Online filing. Being able to download the form does not show that you can file online.
- Filing from abroad. The form, the service page and the publication do not set out a route through a consulate, remote filing or a power of attorney. The form allows a third party to file, but it does not say what that person needs when acting for someone overseas.
Confirm these points directly with RENAP before you rely on them.
Correcting or canceling a registration
We did not find a RENAP correction checklist specific to stillbirths. The general rules of Decreto 90-2005 apply:
- Corrections or additions (Art. 81): these are made under a judicial or extrajudicial resolution. The resolution must be reported to the Civil Registry “en un plazo no mayor de quince (15) dias de ejecutoriada la misma”. In English: within fifteen days after it becomes final.
- Cancellation (Art. 82): an entry is canceled “cuando se ordene mediante resolución judicial firme” (when ordered by a final court resolution). It can also be canceled by an application with documents that clearly and manifestly justify it.
For the general correction procedure, see our record correction page.
