The Constancia de Novedad (“Novedad Constancy”) is a document issued by Guatemala’s Ministry of Government (MINGOB) that certifies that NO other entity with an identical or similar name and/or denomination exists in its registries. It’s used primarily for evangelical churches, foundations, civil associations, charity bingos, lotteries and other non-profit (or limited-purpose for-profit) entities registered or to-be-registered at MINGOB.
Quick summary: Q0 (free) โ no official fee. 8 business days issuance deadline. Procedure with downloadable online form + physical or digital filing. Result: Constancia de Novedad (positive) or Providencia Negativa (negative order) signed by the Head of Registration and Procedure and/or Administrative Subdirector of MINGOB. Used to verify name availability before forming an entity OR to ratify that your entity remains active with a unique name.
Applies to: evangelical churches, foundations, non-profit associations, federations, committees, charity bingos, lotteries, social-purpose raffles and similar entities.
What exactly is the Novedad Constancy?
It’s a certification of name uniqueness issued by MINGOB’s Department of Registration and Procedure. The document confirms one of two possible outcomes:
| Result | Meaning |
|---|---|
| Constancia de Novedad (positive) | The requested name does NOT match any other registered entity โ you may use it |
| Providencia Negativa | The name matches or is too similar to another registered entity โ you must change it |
Issuance is handled by the Head of Registration and Procedure and/or the Administrative Subdirector of MINGOB, who sign the document.
What is it used for?
- Verify name availability before forming a new church, foundation or association. It’s the recommended preliminary step before paying a notary for the incorporation deed.
- Ratify validity of an already-registered entity to third parties (banks, international donors, foreign authorities, cooperation agencies).
- Demonstrate uniqueness of the corporate name when signing agreements, opening bank accounts or applying for registration in other registries (SAT, RTU, IGSS).
- Complementary procedures within the file for legal-person registration at REPEJU.
Who needs it?
Evangelical churches are the most frequent requesters. Guatemala has an extremely active and decentralized evangelical sector โ denominations like Asambleas de Dios, Iglesia de Dios, Centro Cristiano, Comuniรณn Cristiana Internacional, Iglesia del Verbo, Casa de Dios, Lluvias de Gracia, Mega Frater, El Shaddai and thousands of independent congregations operate under corporate names registered at MINGOB.
Other typical users:
- ๐ Foundations โ cultural, educational, environmental, health, sports
- ๐ค Non-profit civil associations โ neighborhood, professional, trade
- ๐ค Federations โ group several associations under the same purpose
- ๐ฒ Charity bingos โ operated by churches, foundations or organizations
- ๐ Lotteries and raffles for social purposes โ authorized by MINGOB
- ๐ซ School and community committees non-profit
- ๐ญ Cultural associations โ folklore, dance, music, theater
- โฝ Non-profit sports associations
What distinguishes these entities is that they are registered or to-be-registered at MINGOB / REPEJU under the regime of non-profit legal persons, in contrast with commercial companies (registered with the Mercantile Registry under the Commercial Code).
File requirements
Confirm the latest list at mingob.gob.gt before assembling your file.
Main document:
- ๐ Constancia de Novedad request form completely filled and signed by the legal representative or authorized requester
- Download the official editable PDF form
- Fill it on a computer (not by hand) to avoid legibility issues
Supporting documents:
- ๐ Valid DPI of the requester or legal representative (legible copy of both sides)
- ๐ Cover letter or explanatory request indicating: entity type, exact name to verify, reason for the request
- ๐ If entity is ALREADY REGISTERED: MINGOB / REPEJU registration number and registered corporate name
- ๐ If entity is TO-BE-FORMED: proposed name and entity type (church, foundation, association, etc.)
- ๐ Contact details: active email and phone
- ๐ Address of the requester or entity
Tip: If your proposed name contains common terms in the religious or foundation sector (Christ, Word, Hope, Blessing, Renacer, etc.), consider adding distinctive elements (geographic location, founder, specific denomination) to reduce the chance of matching another already-registered entity.
Step-by-step process
Download the form. Go to mingob.gob.gt and search for “Constancia de Novedad” or use the direct link to the editable PDF.
Fill the form. Complete fields on a computer: requester data, entity type, exact name you want to verify (with capitals, lowercase and signs exactly as you want it registered), reason, date and signature.
Gather supporting documents. DPI of the requester, explanatory letter if applicable, data of the existing or proposed entity.
File the dossier. Two paths:
- In-person: Department of Registration and Procedure of MINGOB, 6a avenida 4-64, zona 4, Guatemala City. Generally Monday-Friday business hours.
- Digital: Via the repeju.gob.gt platform โ register a user, submit the request and attach documents.
Receive a tracking number. MINGOB provides a receipt with the file number for follow-up.
Wait for the registry search. The Department of Registration searches its databases of churches, foundations, associations, etc. to detect coincidences or similarities with the requested name.
Result issued in ~8 business days:
- If NO match โ positive Constancia de Novedad. Document signed by the Head of Registration and Procedure and/or Administrative Subdirector. Ready for use.
- If MATCH โ Providencia Negativa. Document explaining a similar entity exists. You must change the name and re-submit the request (free of charge).
Pick up the constancy at the Department of Registration and Procedure or download it from the platform if filed digitally.

| Positive result | Constancia de Novedad |

| Renewal | Not a mandatory annual renewal, but some entities request it periodically |
Associated costs (optional):
- Notary for certified copy if foreign donor requests it: Q50-Q200 per certified copy
- Apostille of the constancy for international use (Foreign Ministry): Q50
Common mistakes and what to do if rejected
The five most common causes of Providencia Negativa or delay:
- Name too similar to an already-registered entity. Cause #1. Solution: add distinctive elements (city, founder, specific denomination, year).
- Form filled by hand and barely legible. Always fill it on a computer.
- Expired or illegible DPI. Renew your DPI before filing.
- Missing explanatory letter when it concerns an already-registered entity and the reason isn’t clear.
- Invalid contact details (non-working email, wrong phone) โ if MINGOB needs clarification it can’t reach you.
If rejected (Providencia Negativa):
- MINGOB delivers a document explaining which existing entity has a similar name.
- Change your proposed name by adding distinctive elements.
- Re-submit the form with the new name โ no cost, no additional procedure โ and the 8-day clock restarts.
- If you keep getting Providencia Negativa, consider a name with fewer common religious terms or add geo-tagging (e.g., “Iglesia Cristiana Verbo de Vida โ Mixco” instead of just “Iglesia Cristiana Verbo de Vida”).
Difference vs REPEJU Registration
| Procedure | Function |
|---|---|
| Constancia de Novedad | Verifies name uniqueness โ preliminary or complementary step |
| REPEJU Registration | Grants full legal personality โ entity is born legally |
The Constancia de Novedad does NOT confer legal personality. For your church, foundation or association to have recognized legal personality, the path is:
- Constancia de Novedad (this procedure, optional but recommended)
- Incorporation deed before Guatemalan notary (with bylaws, board of directors, initial assets)
- REPEJU Registration โ formal procedure conferring legal personality
- NIT at SAT โ to issue invoices and operate fiscally
- Bank account and regular operations
Legal framework
- Decree 04-2020 โ NGO Law for Development (Reforms) โ general framework for churches, foundations and associations registered at MINGOB.
- Government Agreement 157-2021 โ Regulations to the NGO Law โ develops procedures, including the Novedad Constancy.
- Civil Code โ Articles 15-32 on non-profit legal persons.
- Political Constitution โ Articles 36-37 (freedom of religion and association).
Religious freedom is constitutionally guaranteed in Guatemala, and MINGOB is the authority that maintains the registry of non-Catholic churches, congregations and religious entities (Catholic ones have a specific regime under the 1852 Concordat and historical recognition). This makes the Novedad Constancy a frequent procedure for the evangelical sector, which forms new congregations every year.
