This page is general information, not legal advice. A denied naturalization application calls for advice based on the actual denial and its service history.
Quick summary: USCIS Form N-336 requests a hearing on an N-400 denial. The USCIS instructions say to file within 30 calendar days of receiving the denial decision; G-1055 lists general fees of $830 on paper or $780 online.
This guide starts after a denial. For the original citizenship application, use the N-400 guide.
Start with the denial and receipt date
The N-336 instructions identify this as a request for a hearing before an immigration officer on denial of Form N-400. Read the denial alongside those instructions and obtain advice promptly about your filing deadline.
USCIS says it generally rejects an untimely request. The same instructions describe an exception: if a late request meets the requirements for a motion to reopen or reconsider, USCIS will reopen or reconsider the case and send a decision. That conditional exception is not a reason to plan a late filing.
Build the request around the denied application
| Part of the request | Information USCIS asks for | Preparation step |
|---|---|---|
| N-400 identification | N-400 receipt number | Match the request to the receipt notice |
| Denial date | Date of the N-400 denial notice | Keep it separate from the date you received the decision |
| Issuing office | USCIS office that issued the denial | Copy the location from the denial |
| Reason for hearing | Reasons you request a hearing on the denied N-400 | Address the denial’s stated reasons |
| Supporting material | Additional documents or briefs | The instructions permit submission at filing or at the hearing |
| Signature and completeness | Properly completed and signed request | Check all required pages and the applicable fee or waiver request |
The preparation steps are an organizational checklist, not a prediction of the hearing result. The identification and reason rows come from Parts 2 and 4 of the USCIS instructions; the supporting-material and signature rows come from its supporting-documents, signature and processing sections.
Check fees, filing instructions and translations
The G-1055 schedule lists $830 for paper filing and $780 online. It lists $0 when the denied N-400 was filed under INA 328 or 329 for military service, and $0 for applicants eligible for a fee waiver. See the I-912 fee-waiver guide for that separate task.
The N-336 instructions direct applicants to USCIS’s N-336 page for current filing information. Use that official page before sending the request; this guide does not reproduce a mailing address.
For Spanish-language supporting documents, the instructions require a full English translation. The translator must certify completeness, accuracy and competence and provide signature, printed name, date and contact information.
Prepare for further USCIS requests
USCIS may request additional evidence or originals, and says it will notify you of its decision in writing. An attorney or accredited representative submits Form G-28 with the request or at the interview, according to the instructions. Other application and document guides are in the diaspora hub.
