This page is general information, not legal advice. A representative can help assess what your notice requires and whether the evidence establishes eligibility.
Quick summary: Use the deadline printed in your RFE; 84 days is not a universal response period. USCIS requires the requested materials together at one time, and Spanish-language evidence needs a full, certified English translation.
This guide addresses responding to the notice. For finding notices and following the case, use the separate USCIS case-status guide. The evidence rules discussed here are USCIS’s general rules, not a separate procedure for Guatemalans.
Read the notice as a list of unresolved requirements
The USCIS Policy Manual says an RFE identifies the eligibility requirements not established, explains why existing evidence is insufficient, identifies missing or deficient evidence, and requests evidence to resolve those issues. It must state the response deadline.
As an organizing aid, make a checklist with one row for each item in your notice and the document that addresses it. This is a preparation suggestion, not a USCIS-mandated cover-letter format. Keep the response tied to what the notice asks you to establish.
The manual says eligibility must exist at the time the benefit request is filed and continue through adjudication. An RFE does not give permission to cure an eligibility deficiency that existed when the benefit request was filed.
Use the notice’s deadline, not a generic countdown
The manual’s maximum-response table distinguishes these categories:
| Benefit request | Maximum response time, calendar days | Additional mailing time in the table |
|---|---|---|
| I-539 | 30 | 3 |
| I-601A | 30 | 3 |
| Other form types, whether initial or additional evidence and whether evidence is domestic or overseas | 84 | 3 |
These are maximums, not a promise that every notice grants that many days. The manual says fixed regulatory maximums take precedence and that certain benefits, including refugee and asylum applications, follow different rules.
For a mailed RFE, service is complete when USCIS mails it, not when the envelope arrives. The manual adds 3 days to the prescribed response period for mailed service. For an RFE uploaded to the online account, service is complete on the upload date. The 3 added days are tied to service by mail.
The manual also describes weekend and federal-holiday rules for mailed responses. It treats an online response as received on its electronic submission date, including weekends and holidays. Follow the actual notice and obtain case-specific advice if its deadline is unclear. The manual says officers cannot grant additional time to respond to an RFE.
Prepare documents and translations together
For evidence in Spanish, include the full document and a full English translation. The translator must certify that the translation is complete and accurate and that they are competent to translate from the source language into English. USCIS says a translated summary is unacceptable.
For originals versus copies, follow the form instructions and the request. USCIS may request an original at any time. For paper filings, the manual lists medical examinations, affidavits and labor certifications as supporting documents that must generally be presented in the original; unless otherwise required, it permits a legible photocopy of any other supporting document at filing; do not use that general rule to ignore a specific demand for an original.
For the separate provisional-waiver task, see the I-601A guide. Its form-specific RFE maximum is one reason to read the notice before planning document collection.
Submit the complete response in the way the notice directs
USCIS’s manual requires all requested materials together at one time with the original RFE. A partial response is treated as a request for a final decision on the record. USCIS does not wait for a second response or issue another RFE simply because the first response was partial.
Under this guidance, failure to respond within the requested timeframe can result in denial as abandoned, denial on the record, or both. The manual’s exceptions matter; this page is not a substitute for benefit-specific rules. For help with a deficient response or an approaching deadline, see finding accredited immigration help.

Frequently Asked Questions
Does every RFE give me 84 days?
No. The USCIS Policy Manual sets maximum timeframes, and the notice must state the deadline. Its table lists 30 calendar days for I-539 and I-601A and 84 for other forms, subject to the stated regulatory exceptions and mailing rules.
Can I send some evidence now and the rest later?
USCIS requires the requested materials together at one time with the original RFE. A partial response is treated as a request for a final decision on the record; USCIS does not wait for another response just because the first was partial.
Do Spanish documents need a full translation?
Yes. USCIS requires a full English translation, with the translator’s certification of completeness, accuracy and competence. A translated summary is unacceptable.
What happens if I do not respond by the deadline?
Under the cited guidance, USCIS may deny the benefit request as abandoned, based on the record, or for both reasons. Certain benefits, including asylum, have different rules.
