Quick summary
| Topic | Rule | What to do |
|---|---|---|

| Minimum drinking age | Alcohol sales to people under 18, and their consumption in establishments and on public streets, are prohibited | Do not buy alcohol for minors |
| Public drinking | Prohibited on public streets, in public parking lots and in parking lots reserved for establishments selling food or alcohol | Do not carry your drink outside to continue drinking |
| Electoral ley seca | Alcohol sale or distribution and consumption in public places prohibited from noon the day before the election until six in the morning the day after | Check official election notices before making plans |

| Bares, municipal sound table | Interior: 75 dB.; exterior: 40 dB | Do not assume indoor music levels are permitted outside |

The alcohol-hours rule comes from Acuerdo Gubernativo 56 - 2022; the age and public-drinking rules come from the Health Code. Election restrictions are in the TSE electoral-law compilation, and the indoor smoking prohibition is in Decreto 74-2008.
Plan your night out
- Ask about authorized closing time and the alcohol cutoff separately. A venue may be authorized to remain open after alcohol sales and consumption must stop. Do not assume you can finish a purchased drink during the prohibited period.
- Check whether your dates fall under an exception or election restriction. The holiday exception concerns the national hours restriction; it does not itself extend a venue’s license or cancel other rules. Check official notices for temporary restrictions before going out.
- Keep alcohol away from minors and public streets. Do not move to a public parking lot or the establishment’s reserved parking area to continue drinking.
- Respect sound limits and indoor smoking rules. A terrace is not permission to turn up the music. Ask staff where smoking is permitted rather than treating an indoor smoking area as automatically lawful.
- Arrange your return before leaving. Use our Guatemala safety guide for broader safety planning. For daytime things to do in Antigua, see the Antigua walking tour and Antigua coffee tours.
Alcohol service and closing time are separate rules
The national agreement covers establishments open to the public regardless of category: discos, restaurants, dining establishments, nightclubs, cantinas, bars, alcohol outlets, hotels, motels and guesthouses, as well as supermarkets, self-service markets, grocery shops, convenience stores and similar businesses. It expressly permits them to remain open during hours authorized by the competent authority, provided they comply with the agreement.
Owners, legal representatives, managers, people in charge and employees are jointly responsible for noncompliance. The agreement specifies an establishment fine of Q. 100,000.00 and initiation of proceedings to cancel the owner’s commercial registration, license or permit, without prejudice to criminal proceedings under other laws. It also specifies Q.5,000.00 for individuals who help violate the rule through their economic activity or work, or who consume the covered drinks in those establishments during prohibited hours, without prejudice to criminal proceedings under other laws.
The annual holiday exception applies to the hours restriction on December 24, December 25, December 31 and January 1. It is not permission to disregard licensing, public-drinking or smoking rules.
Public drinking and legal age
The Health Code prohibits sales of alcohol and tobacco in any form to people under 18, as well as their consumption in establishments and on public streets. For alcohol, it also prohibits consumption in public parking lots and parking lots reserved for businesses selling food or alcohol, as well as on public streets.
For drinking in a food or alcohol establishment’s reserved parking area, the Code specifies a fine against the establishment of Q. 15, 000.00. Repeat infringement doubles the first fine; continued infringement leads to action under the Health Code provisions identified in that text. This is an establishment sanction, not a quoted personal street-drinking fine.
Ley seca around elections
The electoral provision covers the sale or distribution of liquor, alcoholic and fermented beverages, and their consumption in public places. Its window begins at noon on the day before the election and ends at six in the morning on the day after it. Do not treat the ordinary national alcohol-hours rule as the only restriction when an election is taking place.
Noise and smoking inside venues
Antigua’s municipal sound table distinguishes discotecas, bares and restaurantes, with separate interior and exterior maxima shown above. Its hours column refers to a nighttime schedule rather than giving a clock closing time. Sound authorization does not establish how late alcohol may be sold or consumed.
The tobacco law prohibits smoking or keeping tobacco products lit in enclosed public places, workplaces and public, collective or community transport. Its hotel and motel exception concerns designated smoking guest rooms: no more than twenty percent of rooms, grouped on the same floor in adjoining rooms, with smoke prevented from entering prohibited areas. A nonsmoking room’s status may change only if an additional nonsmoking room is added. That guest-room exception does not authorize smoking inside a bar.
