For a foreign or diaspora employer this is the trap: the rate you are quoted is not a defence if the arrangement is later assessed as employment. The market average is negotiating context. The minimum is what you owe.

The market average is what gets reported, not what is lawful. Our domestic worker minimum wage page is explicit that the Labor Code makes no distinction by type of work: domestic workers are entitled to the Non-Agricultural minimum wage for their economic zone, set for 2026 by Acuerdo Gubernativo 256-2025, plus the mandatory Q250 bonificación incentivo under Decreto 78-89. The same page notes the wage follows the department where the work is performed, not where the employer lives.

On live-in arrangements: the Labor Code permits payment in kind, and where no proportion has been agreed, 30% of total wages is understood to correspond to it. Our minimum wage page puts the resulting cash floor at about Q2,977/month in CE1 — but is equally clear that in practice most Guatemalan families pay the full cash wage and provide room and board on top as a benefit. Payment in kind complements the salary; it does not replace it and it does not reduce the statutory benefits.
On by-day work: it is not a loophole. Our guide to hiring domestic help states that continuous by-day work becomes a full de planta employment relationship with every benefit attached — occasional independent day labor is one thing, the same person cleaning your house on a fixed weekly schedule for months is an employee. There is no published hour or day threshold that flips the switch; regularity, not the label, is what creates the relationship.

The budgeting rule foreign employers most often get wrong: you are paying roughly 14 salaries a year, not 12 — twelve monthly wages plus Bono 14 plus Aguinaldo — plus the IGSS contribution. Our wage page works the full-time CE1 case at about Q60,246.56 per year (~$7901 USD ) all-in:

Note also that the Q250 bonus is excluded from the Bono 14, Aguinaldo, vacation and severance base. Calculating those on Q4,252.28 instead of Q4,002.28 overpays; calculating the monthly wage on the base alone underpays.

Do I Have to Register Her with IGSS?
This is the question foreign employers ask most, and it deserves an honest answer rather than a confident one. Our own pages state both halves of it:
- IGSS employer registration applies in principle from the first employee, including a household with one worker. Our IGSS employer registration page covers the standard-regime route.
- PRECAPI is the special IGSS track built for domestic workers and the practical route for a household with one employee — see IGSS-PRECAPI for domestic workers.
- But our domestic worker minimum wage page describes PRECAPI as a voluntary programme with no formal fine for not enrolling, and our hiring guide adds that enforcement against private households is effectively nil, which is why fewer than 5% of domestic workers are IGSS-affiliated.
What makes it an easy decision anyway is the price. Per our PRECAPI page, the contribution is not a percentage of the real salary and is not paid monthly. It is a fixed percentage of the current non-agricultural minimum wage (Q4,002.28 in 2026), paid quarterly in advance at Banrural:

Paying her more does not raise the quota. The same page notes that because PRECAPI is voluntary, IGSS does not impose the formal fines applied to formal employers — but an unpaid quarter costs the worker: those months do not count toward her 240 IVS contributions or toward maintaining continuous EMA medical coverage.
What underpaying actually costs. Per our wage page, Labor Code Art. 272 literal a) as reformed by Decreto 7-2017 carries a fine of 8 to 18 monthly minimum wages — Q32,018 to Q72,041 at the CE1 base (Q30,535 to Q68,704 at CE2) — plus retroactive back-pay with interest. The worker can file at MINTRAB’s General Labor Inspection, through the anonymous 1539 hotline, or online.
The Written Contract
A verbal contract is valid at the start. Our hiring guide states that a written contract is legally expected once the relationship passes 60 days, and that MINTRAB publishes a free template, so there is no drafting cost. Put in writing: schedule, base salary, the Q250 bonificación listed separately (which protects you later, since it is excluded from the Bono 14, Aguinaldo and severance base), the rest day, vacation, the IGSS or PRECAPI arrangement, live-in terms if any, and the pay date.
The same guide adds the record-keeping rule: a dated pay receipt showing base salary and the Q250 bonus, signed by the worker, every payday, and keep records for six or more years. Our employment contract format page covers the document itself.
Hiring from Abroad
Diaspora families in the US employ housekeepers and caretakers in Guatemala routinely. Per our wage page, the obligations are identical to those of an employer living in the country. The practical setup:
- Have a trusted relative or a Guatemalan attorney sign the contract under a poder especial (special power of attorney).
- Pay by bank transfer so every payment is documented — cash is legal but makes contributions harder to evidence.
- Enrol the worker in IGSS-PRECAPI, which requires an in-person visit by you, the worker, or your representative.
- Set calendar reminders for Bono 14 in July and Aguinaldo in December — the two things easiest to forget from abroad.
- Keep the payment records. Six or more years, per our hiring guide.
Hiring Well: What to Ask For
- Define the schedule and tasks in writing — cleaning, cooking, childcare, days and hours.
- Pay at least the minimum wage for her economic zone. The market average is not a justification for paying less.
- Respect the rest periods — a daily rest and one full day off per week.
- Register as an employer with IGSS (or enrol her in PRECAPI) and report the worker.
- Budget the 14 monthly payments plus IGSS, not just the monthly wage.
- Put everything in writing — salary, schedule, tasks, rest day, and payment in kind if it applies.
Red Flags — Practices to Avoid
- Paying below the minimum wage because it is the market average — that is a labor violation, not a negotiation.
- Not paying Aguinaldo or Bono 14 — both are mandatory, with no exception for domestic work.
- Not giving vacation — 15 working days a year is a right.
- Not registering the worker with IGSS — employer registration is the employer’s obligation.
- Using payment in kind to avoid paying a cash wage — lodging and food complement the salary, they do not replace it.
- Ignoring the rest periods — the domestic workday has statutory rest limits.
