What Raises the Rate

  • The patient’s level of dependency — the number one variable: an independent older adult who needs company does not cost what a bedbound, post-operative or dementia patient costs
  • Day vs night vs 24 hours — night shifts and continuous cover are quoted with a surcharge
  • Empirical caregiver vs qualified nursing auxiliary — training moves the price from Q150-250 to Q400+
  • Agency vs hiring directly — the agency charges more but sends a replacement if the caregiver is absent, and verifies credentials for you
  • Zone and travel — shifts in outlying municipalities or starting before dawn add transport cost

Live-in arrangements are legal and common in elderly care. Per our wage page, the cash minimum is the same; lodging and food may legally count as up to 30% of total wages (a cash floor of about Q2,977 CE1), but in practice most Guatemalan families pay the full cash wage and provide room and board on top.

IGSS: the honest position

Our own pages state both halves, and so will we:

  • IGSS employer registration applies in principle from the first employee, including a household with one worker — see IGSS employer registration (standard regime: 12.67% employer, 4.83% worker).
  • PRECAPI is the special IGSS track for domestic workers and the practical route for a household — see IGSS-PRECAPI for domestic workers.
  • But our wage page describes PRECAPI as voluntary, with no formal fine for not enrolling, and our hiring guide notes that enforcement against private households is effectively nil — fewer than 5% of domestic workers are affiliated.

The cost makes it an easy call regardless. PRECAPI is a fixed quota on the minimum-wage base, paid quarterly in advance at Banrural, not a percentage of what you actually pay:

It covers medical care, hospitalisation and medicines, maternity leave at 100% of salary for 84 days, work-accident care, and IVS pension credit — and paying her more does not raise it.

What underpaying costs: per our wage page, Labor Code Art. 272(a), as reformed by Decreto 7-2017, carries a fine of 8 to 18 monthly minimum wages — Q32,018 to Q72,041 at the CE1 base (Q30,535 to Q68,704 at CE2) — plus retroactive back-pay with interest.

Day shifts or employment? Where the line is

Loose day shifts work in practice as a service quoted by the day. A continuous relationship does not. Our hiring guide states it plainly: occasional, genuinely independent day work is one thing, but the same person working a fixed schedule for months is an employee — with the full package attached, retroactively. No published hour or day threshold flips the switch, so the safe reading is that regularity, not the label, creates the relationship.

Elderly care is precisely where this creeps up on families: what starts as a few days a week while Mom recovers becomes eighteen months of daily cover without anyone deciding to change the arrangement.

Hiring from the United States for a Parent in Guatemala

This is one of the most common diaspora arrangements, and per our domestic worker wage page the legal obligations are identical to those of an employer living in Guatemala. The setup it describes:

  1. Sign the contract through a Guatemalan relative or attorney under a poder especial (special power of attorney). You can hire directly from abroad, but this simplifies everything.
  2. Register the worker in IGSS-PRECAPI. This needs an in-person IGSS visit by you, the worker, or your power-of-attorney representative.
  3. Pay monthly by bank transfer — Wise, Remitly, or a Guatemalan bank transfer if you keep an account there. Cash is legal but makes contributions harder to document.
  4. Track Bono 14 (July) and Aguinaldo (December). Easy to forget from abroad; set calendar reminders.
  5. Keep payment records — 6+ years of payment history, in case of any dispute or termination claim.

The mistakes our wage page flags for diaspora employers specifically: paying “what feels right” without checking the official minimum (back-pay plus an Art. 272(a) fine), skipping IGSS affiliation, missing Bono 14 or Aguinaldo (a significant back-pay claim at termination), a verbal-only agreement past 60 days, and discharging without severance.

How to Negotiate

  1. Define the real level of care before asking for a price — company and assistance, or specialised care? That is what separates Q150 from Q400+ per day
  2. Ask for a patient assessment — serious agencies do one before quoting; describe the case identically to 2-3 agencies and compare real quotes
  3. Put the shift pattern in writing — day, night, weekends, holidays and their surcharges
  4. Ask what happens if the caregiver is absent — a guaranteed replacement is the real value of paying agency rates
  5. If it is full-time, formalise it — the minimum wage for the zone, IGSS, Aguinaldo and Bono 14. Cheap and informal turns expensive in a labour claim
  6. Ask for verifiable references and recent criminal and police record certificates if you hire directly

Red Flags

  • A closed price for a complex patient without assessing them first
  • A “nursing auxiliary” who cannot show a qualification or a card
  • A full-time salary well under Q4,000/month — besides being unlawful, it guarantees turnover
  • Will not give references from other families, or the numbers “never answer”
  • An agency with no written contract and no invoice for monthly plans
