When your mother or father dies in Guatemala and you live in the United States, four things run on separate clocks. The death is registered at RENAP, and the RENAP Law sets 30 days for that, free of charge inside the term. If your parent received US Social Security, SSA has to be told, and the payment for the month of death goes back. If your parent had to file US income tax returns, the IRS asks for a final return for the year of death, prepared as if they were still alive. And if a US office asks for an apostille on a Guatemalan document such as the death certificate, MINEX issues it at Q75 per certificate (about US$9.82).
This page puts those steps in order for a son or daughter in the US. It links our detailed guides rather than repeating them. Figures are as of 5 November 2026.

Registering the death at RENAP
RENAP, Guatemala’s national civil registry, records the death and issues the death certificate.
Deadline. Article 84 of the RENAP Law (Decreto 90-2005) says civil-status events must be registered within 30 days of happening. After that the registration is late (extemporánea), and the same article adds that the right to register is never lost. Late registrations carry a cost set by RENAP’s regulation; our death registration guide covers the late-registration requirement lists.
Cost. Article 84 also makes every registration within the 30 days free. RENAP’s tariff (Art. 10) says the first death certification, issued at the moment of registration, is not charged; later certifications are charged at the tariff rate. The tariff lists Q25.00 (about US$3.27) for certifications of the other registrations it does not price separately.
Documents. RENAP’s requirement list for a death in Guatemala has three items:
- The death report (informe de defunción).
- The deceased’s DPI, or one of the substitutes RENAP lists: a certification of the DPI, the old cédula de vecindad or a certified copy of its book entry, or, failing those, the deceased’s birth certificate.
- The DPI of the person who appears to register the death (the compareciente).
The list names no family relationship that the person appearing must have to the deceased, which matters if a brother, sister or other relative is already in Guatemala and you are not. RENAP also lists the minimum contents of the death report: the name of the deceased where they can be identified, sex, cause of death, and the place, date and time of the death or of the removal of the body.
Burial in Guatemala or bringing your parent home
The family in Guatemala may have to make this decision before you can get there. For local prices, see our funeral services price guide. If your parent was a US citizen, SSA’s guidance says the closest US embassy or consulate should also be told about the death; what the embassy does and does not do, and the choice between local burial, cremation and repatriation, is covered in if a foreigner dies in Guatemala.
Flying down on short notice
Check your travel document before you book. If your Guatemalan passport has expired, see renewing a Guatemalan passport from the USA; for the national ID, see getting your DPI from the USA. If you are in the US without permanent residence or citizenship, or with an application pending, read our page on advance parole before travelling to Guatemala before you leave the country.
Social Security: report the death and return the month-of-death payment
If your parent received US Social Security benefits, SSA’s page on what to do when someone dies sets out how the death is reported:
- Who reports. SSA says funeral homes generally tell it when someone dies. If a funeral home is not involved or does not report the death, SSA asks you to call and give the person’s name and Social Security number and the dates of their birth and death.
- Which number. From the US: +1 800-772-1213 (TTY +1 800-325-0778), weekdays from 8 a.m. to 7 p.m.; English, Spanish and other languages are offered. For people who live outside the US, SSA gives its Federal Benefits Units or the International Call Center at +1-855-522-6936.
- US citizens. If your parent was a US citizen, SSA says to notify the closest US embassy or consulate as well.
- Month of death. SSA’s booklet for beneficiaries outside the US says SSA pays no benefit for the month in which a beneficiary dies. Its example: if a beneficiary dies at any time in June, the payment dated July (the June payment) has to be returned.
- Survivors. SSA says a surviving spouse may receive a single $255 death payment and that, when there is no spouse, certain children can qualify instead. Certain family members may qualify for monthly survivor benefits.
For how SSA treats family members who live in Guatemala, see Social Security for family living in Guatemala.
The IRS: a final return if your parent had to file US taxes
If your parent had to file US income tax returns, the IRS says the final return is prepared the same way as if the person were alive: include everything they earned until the day they died and take the credits and deductions they qualify for. Whoever handles the return is responsible for paying any balance due. A refund on the final return is claimed with Form 1310, and IRS Publication 559 covers survivors, executors and administrators.
The inheritance in Guatemala
How property, bank accounts and vehicles in your parent’s name pass to the heirs is covered in our guide to the succession process, which explains the notarial route (when all heirs agree) and the court route. Two related pages: renouncing an inheritance, if you would rather give up your share, and the US side, receiving an inheritance from Guatemala and IRS Form 3520.
You may not need to be there in person. The Notarial Code (Art. 6) lets Guatemala’s consuls and diplomatic agents posted abroad act as notaries when they are qualified notaries. Our page on the consular power of attorney explains how to give a relative or lawyer in Guatemala authority to act for you.
An apostille for the death certificate
If a US bank, court or agency asks for the Guatemalan death certificate with an apostille, the apostille comes from Guatemala’s Ministry of Foreign Affairs (MINEX), which issues apostilles through an online request system. Its terms and conditions say:
- Cost. Q75.00 per apostille or legalization certificate (about US$9.82), under Decreto 2-2023.
- Stamp tax. The fiscal stamp tax (timbres fiscales) on each certificate is paid with a form generated on the platform of the tax authority, SAT.
- Payment window. Both payments are due within 10 days of the date the request is approved; after that, the request expires.
- No refunds. Once paid, MINEX does not refund the payment or move it to a different request.
- Format. The certificates are electronic and do not need a handwritten signature or an ink or dry seal.
Step-by-step instructions are in our MINEX apostille guide.
A short checklist
- RENAP registration done within 30 days, and the free first death certification collected at that moment.
- Extra certified copies ordered for the inheritance, banks and US offices.
- SSA called, if no funeral home reported the death, and any payment for the month of death returned.
- US embassy or consulate told, if your parent was a US citizen.
- Final US tax return planned, if your parent had to file in the US.
- Apostille requested for any certificate a US office has asked to see apostilled.
- Consular power of attorney signed, if someone in Guatemala will handle the succession for you.

Frequently Asked Questions
Who registers my parent's death in Guatemala, and by when?
The death is registered at RENAP. The RENAP Law (Decreto 90-2005, Art. 84) sets 30 days from the event; after that the registration counts as late (extemporánea), but the right to register is never lost. RENAP’s requirement list asks for the death report (informe de defunción), the deceased’s DPI or one of the substitutes it lists, and the DPI of the person who appears to register.
Does registering the death cost anything?
Not inside the 30 days: Art. 84 of the RENAP Law makes every registration within that term free. RENAP’s tariff adds that the first death certification issued at the moment of registration is free; later certifications are charged at the tariff rate, which lists Q25.00 for certifications of the other registrations it does not price separately.
My father received Social Security. Who tells SSA?
SSA says funeral homes generally report deaths. If a funeral home is not involved or does not report it, you call SSA and give his name and Social Security number and the dates of his birth and death: +1 800-772-1213 from the US. If he was a US citizen, SSA says to notify the closest US embassy or consulate too. SSA pays no benefit for the month in which a beneficiary dies, so the payment covering that month has to go back.
Do I need an apostille on the Guatemalan death certificate?
If the document will be used in the US and the receiving office asks for one, the apostille is issued by Guatemala’s Ministry of Foreign Affairs (MINEX) through its online system. Its terms set Q75.00 per apostille certificate, plus the stamp tax (timbres fiscales) paid with a form generated on the SAT platform, both within 10 days of approval.
Do I have to fly to Guatemala to handle the inheritance?
The Guatemalan Notarial Code (Art. 6) lets the Republic’s consuls and diplomatic agents abroad act as notaries when they are qualified notaries. Our page on the consular power of attorney explains how to sign one at a Guatemalan consulate in the US; the inheritance steps themselves are covered in our guide to the succession process in Guatemala.
