Notice Period by Tenure (Art. 83)

| 6 months to 1 year | 10 days |
| 1 to 5 years | 2 weeks |
| More than 5 years | 1 month |
Your employer can waive the notice (let you leave earlier) — request it in writing in the same letter; the template includes that option. If you leave without notice and without a waiver, the employer may deduct the unworked notice from your final settlement.
What You Keep When You Quit
Article 12 of the Labor Code makes labor rights non-waivable. Resigning voluntarily, you still receive:
- Unused vacation — always paid out (calculator)
- Proportional aguinaldo — December to your exit date
- Proportional Bono 14 — July to your exit date (calculator)
- Pending salary and earned commissions
What you normally do not get when resigning is severance pay (indemnización, Art. 82) — that belongs to unjustified dismissal.
How to Hand It In (protect yourself)
- Fill the template and choose your variant (with notice / immediate with waiver).
- Print two copies — one for the employer, one for you.
- Deliver to HR or your manager and have them sign and date your copy as received. That copy is your proof.
- If asked, get your signature notarized (Q50-Q150 — notary fees).
- On exit, demand your employment certificate (Art. 87) and check your final settlement against the calculators before signing — see the final settlement guide.
