Your employer can waive the notice (let you leave earlier) — request it in writing in the same letter; the template includes that option. If you leave without notice and without a waiver, the employer may deduct the unworked notice from your final settlement.

What You Keep When You Quit

Article 12 of the Labor Code makes labor rights non-waivable. Resigning voluntarily, you still receive:

  • Unused vacation — always paid out (calculator)
  • Proportional aguinaldo — December to your exit date
  • Proportional Bono 14 — July to your exit date (calculator)
  • Pending salary and earned commissions

What you normally do not get when resigning is severance pay (indemnización, Art. 82) — that belongs to unjustified dismissal.

How to Hand It In (protect yourself)

  1. Fill the template and choose your variant (with notice / immediate with waiver).
  2. Print two copies — one for the employer, one for you.
  3. Deliver to HR or your manager and have them sign and date your copy as received. That copy is your proof.
  4. If asked, get your signature notarized (Q50-Q150 — notary fees).
  5. On exit, demand your employment certificate (Art. 87) and check your final settlement against the calculators before signing — see the final settlement guide.
