If you own a house or land in Guatemala and live far from it, the worry is simple: someone uses a forged document to sell or mortgage it while you are away. Guatemalan law gives owners a tool for this. Under Decreto 62-97, you can ask the property registry to freeze (inmovilizar) your registered property so that it cannot be disposed of or encumbered for up to three years at a time, renewable. A notary assists with the request. A 2022 government notice describes both an online and an in-person route (current online availability not verified). Lifting the freeze early requires your own sworn statement and fingerprint, which the registry must verify. This page covers the request, the fee, how long it lasts, how to lift or renew it, and what it does not stop.
Quick summary: Owners of registered property may voluntarily restrict its disposal or encumbrance for a maximum of three years each time (Decreto 62-97, Art. 1). You file a written request with notarized signatures, your personal identification details, your fingerprint, the property’s identification and a sworn statement that no earlier transfer or mortgage is pending registration. If you set no period, the maximum applies, counted from the day the registry makes the annotation (Art. 2). It can be extended by equal periods, and it expires on its own (Art. 3). Lifting it early needs a notarial sworn statement with fingerprint; the registry verifies the fingerprint in no more than 10 days from the day after you file. A 2022 government notice put the fee at Q160, same online or in person; current tariff not verified. It does not block court orders (Art. 5). General information, not legal advice.
What the freeze does
The core rule is Article 1 of Decreto 62-97, published by the Registro General de la Propiedad (RGP):
«Los propietarios de bienes inscritos en los Registros de la Propiedad, tienen el derecho de limitar voluntariamente su enajenación o gravamen por un plazo máximo de tres años cada vez»
In plain terms: if your property is registered, you have the right to restrict, voluntarily, its disposal (sale or any other transfer) and its encumbrance (a mortgage or other charge) for up to three years at a time.
The registrar records the freeze as an annotation in the margin of the property’s ownership registrations. The law sets the speed: «El Registro de la Propiedad deberá realizar las anotaciones de inmovilización en forma inmediata.» (the registry must make freeze annotations immediately). That is a legal duty, not a measured service time. The registry’s current turnaround could not be confirmed.
Because the annotation sits on the property’s record, that record is where to look for it afterwards. See how to search a property record at the RGP and how to order a property certification.
What goes in the request
The request is a written document (escrito) signed by the owner. Decreto 62-97 requires it to be made «mediante escrito con legalización notarial de firmas que contenga todos los datos de identificación personal, la impresión de su huella dactilar, así como la identificación de los bienes que se desea afectar» (a written request with notarized signatures, containing all personal identification details, the owner’s fingerprint, and the identification of the property to be frozen).
The law also requires a sworn declaration. The owner’s request must be made «bajo juramento de decir verdad de que no existe cesión a ningún título ni hipoteca pendiente de inscribir, otorgados con anterioridad a la fecha de suscripción» (under oath that no transfer of any kind and no mortgage, executed before the date of signing, is pending registration).
| Element | What the law asks for |
|---|---|
| Form | Written request (escrito) |
| Signature | Signatures legalized by a notary (legalización notarial de firmas) |
| Identity | All personal identification details of the owner |
| Fingerprint | The owner’s fingerprint printed on the request |
| Property | Identification of the property or properties to be frozen |
| Sworn statement | No earlier transfer or mortgage pending registration |
| Period | Up to three years; if none is stated, the maximum applies |
Buying a property? The freeze does not have to be a separate step. The law says «La solicitud también podrá hacerse en el instrumento público en que se adquieran los bienes a cualquier título» (the request may also be made in the public instrument through which the property is acquired, under any title). So the freeze can go into the purchase deed itself. For the purchase and registration side, see registering a property at the RGP and buying property in Guatemala from the USA.
How long it lasts
| Rule | Source |
|---|---|
| Maximum of three years each time | Decreto 62-97, Art. 1 |
| If no period is stated, the annotation is made for the legal maximum | Art. 2 |
| The period runs from the day the registry makes the annotation | Art. 2 |
| Can be extended for one or more equal periods | Art. 3 |
| On expiry, the annotation stops having effect with no further action | Art. 3 |
Article 2 reads: «Si los interesados no fijaren plazo alguno, se hará la anotación por el plazo máximo establecido en esta ley» (if the applicants set no period, the annotation is made for the maximum period set by this law). It also says the period «se computará a partir del día en que el Registro efectúe la anotación que corresponda» (is counted from the day the registry makes the annotation). The clock starts at the annotation, not at the day you sign.
Step by step
A notice dated February 18, 2022 on the government’s press portal (prensa.gob.gt) announced the RGP’s online freeze request and describes the procedure. It starts with a notary: the owner «debe acudir a su Notario de confianza para que le brinde acompañamiento, tanto para el proceso en línea, como presencial» (should go to a notary of their choice for assistance, whether for the online or the in-person process). The online route below comes from that 2022 notice. Its current availability could not be verified because the RGP’s online services page returned an access error.
- Choose a notary. Per the 2022 notice, the notary assists you through either the online or the in-person process.
- Sign and print your fingerprint. You sign the request and print your fingerprint. The law requires your signature to be legalized by a notary.
- Online route: the notary scans and signs it electronically. Per the 2022 notice, «el Notario autorizante deberá escanear el documento en formato PDF y firmarlo electrónicamente, utilizando su firma electrónica avanzada» (the authorizing notary must scan the document as a PDF and sign it with their advanced electronic signature). This is done under Decreto 47-2008, the Ley para el Reconocimiento de las Comunicaciones y Firmas Electrónicas.
- The document is sent from the RGP website. The legalized document «deberá enviarse desde la página web del Registro General de la Propiedad, en el mismo apartado de Inmovilización de Propiedades» (must be sent from the RGP website, in the same Inmovilización de Propiedades area), in the section Presentación de Documento. The notice does not say who sends it, so ask your notary. The current submission address could not be confirmed because the RGP website blocked access when this page was researched.
- Pay with the pre-entry code. The notice says: «Este proceso generará un código de pre-ingreso, con el cual deberá pagar Q160 en cualquier agencia o bien desde la Banca Virtual de Banrural, según el arancel vigente.» (The process generates a pre-entry code, with which you pay Q160 at any agency or through Banrural’s online banking, according to the tariff in force.)
- The registry makes the annotation. By law, immediately (see above).
In person: the 2022 notice says the in-person request at RGP offices «sigue vigente y tiene el mismo costo de arancel, que el trámite en línea» (remains available and has the same tariff as the online procedure). Office addresses could not be confirmed from the sources retrieved.
Fees
| Item | Amount | Status |
|---|---|---|
| Registry fee (online or in person) | Q160 | From a government notice dated February 18, 2022; the RGP’s tariff page returned an access error when checked, so the current amount is not verified |
| Notary’s fee | Not set by these sources | Agreed with the notary |
| Fee to cancel the freeze early | Not stated in the sources retrieved | Ask the notary or the RGP |
Owners living in the USA or elsewhere abroad
This is the case the freeze suits best, and also the one the sources cover least. What is established:
The request carries the owner’s signature and fingerprint. The signature is legalized by a notary, and the owner prints their fingerprint on the request.
An online route was described in 2022. Per the 2022 notice:
- the authorizing notary scans the document and signs it electronically;
- the legalized document is sent from the RGP website;
- the fee can be paid through Banrural’s Banca Virtual.
The notice does not say who sends the document, and the route’s current availability could not be verified.
Representatives appear in an RGP guide. A historical RGP guide (Guía 19, edition marked Gestión 2004-2008) lists, at item 3.1, «Los mandatarios que pueden disponer de los bienes del mandante» (representatives who can dispose of the principal’s property). That is an old edition, and it does not by itself describe how a representative would file a freeze.
The sources retrieved do not establish a full procedure for an owner who signs abroad, or one carried out through a Guatemalan consulate. Before you rely on a representative, ask a Guatemalan notary exactly what power of attorney and what signature format they need. For powers of attorney in general, see consular power of attorney.
Lifting the freeze early (cancellation)
If you want to sell or mortgage before the period ends, you ask for the freeze to be cancelled. Article 4 says that while the annotation is in force, the owner or owners may request its cancellation, as follows:
- «En acta notarial de declaración jurada en la que conste la decisión del propietario de cancelar la limitación que recaiga sobre el bien» (in a notarial sworn statement recording the owner’s decision to cancel the restriction on the property). The owner also prints their fingerprint on it.
- «Acreditar fehacientemente la propiedad del bien» (reliably prove ownership of the property).
- «Certificación extendida por el Registro de Vecindad del lugar en donde se haya extendido la Cédula de Vecindad del solicitante, en que conste el número de Cédula, folio y libro en que se encuentre inscrita» (a certificate from the Registro de Vecindad where the applicant’s Cédula de Vecindad was issued, stating its number, folio and book).
The published text still names the Cédula de Vecindad certificate. No current RGP checklist could be retrieved showing what the registry asks for today on this point, so confirm it with your notary.
The fingerprint check. Before cancelling, the registry must verify the authenticity of the fingerprint by appropriate technical-scientific means, itself or through a contractor. The law sets a limit: «Dicho trámite no podrá ser mayor de diez (10) días contados a partir del día siguiente de la presentación de la solicitud de cancelación de inmovilidad.» (That procedure may not take more than ten (10) days, counted from the day after the cancellation request is filed.) If you are planning a sale, build those days into the timeline.
The other way out is simply to let it expire: the annotation stops having effect on its own when the period ends (Art. 3).
Extending the freeze
Article 3 says the requested or statutory period «podrá ser prorrogado mediante solicitud que contenga las características establecidas en esta ley, por uno o más períodos iguales» (may be extended, through a request with the characteristics set by this law, for one or more equal periods). So an extension is a new request, and it must have the characteristics the law sets out: the elements described under What goes in the request, above, including the sworn statement. Confirm the exact content with your notary.
The law says «Vencido el plazo respectivo, la anotación dejará de surtir efectos sin necesidad de gestión alguna.» (once the period expires, the annotation stops having effect without any action). So the registry does not renew it for you. Note the end date, counted from the day of the annotation, and talk to your notary well before it.
What the freeze does not do
Article 5 sets the limits. The voluntary freeze «no impide que se efectúen inscripciones, anotaciones o cancelaciones de cualquier naturaleza, originadas de orden judicial, ni afectan operaciones ya inscritas» (does not prevent entries, annotations or cancellations of any kind that come from a judicial order, and does not affect transactions already registered).
So a freeze:
- does not stop an embargo or other entry ordered by a court;
- does not undo a sale or mortgage already registered before the freeze.
It also does not replace keeping an eye on the record. Ordering a property certification from time to time shows you what is registered.

Frequently Asked Questions
What is a property freeze (inmovilización) in Guatemala?
Under Decreto 62-97, owners of property registered in the property registries can voluntarily restrict its disposal (enajenación) or encumbrance (gravamen) for a maximum of three years at a time. The registrar enters an annotation in the margin of the property’s ownership registrations, and the law says freeze annotations must be made immediately.
How much does a property freeze cost?
A government notice dated February 18, 2022 put the registry fee at Q160, paid with a pre-entry code (código de pre-ingreso) at any agency or through Banrural’s Banca Virtual, according to the tariff then in force. It said the in-person request has the same tariff as the online one. The registry’s current tariff page could not be retrieved, so confirm the amount before paying. The notary’s fee is separate and is not set by these sources.
Can I freeze my property in Guatemala while living in the United States?
The sources available do not set out an end-to-end procedure from abroad or through a consulate. What they show: the request is signed by the owner, with notarized signatures and the owner’s fingerprint; a 2022 government notice describes an online route in which the authorizing notary scans the document and signs it with an advanced electronic signature, and the document is sent from the RGP website (current availability of that route not verified); and a historical Registro General de la Propiedad guide (edition marked Gestión 2004-2008) lists representatives (mandatarios) who can dispose of the principal’s property. Ask a Guatemalan notary how they would handle your case.
What happens when the three years run out?
Decreto 62-97 Art. 3 says that when the period expires, the annotation stops having effect without any further action. The requested or statutory period can be extended for one or more equal periods through a request with the characteristics set by the law.
How do I lift the freeze early, for example to sell?
Decreto 62-97 Art. 4 lets the owner request cancellation while the annotation is in force, through a notarial sworn statement (acta notarial de declaración jurada) recording the decision, with the owner’s fingerprint, plus reliable proof of ownership and a certificate the published text ties to the Cédula de Vecindad. Before cancelling, the registry must verify the fingerprint’s authenticity; the law says that step may not exceed 10 days, counted from the day after the cancellation request is filed.
Does a property freeze stop a court order?
No. Decreto 62-97 Art. 5 says a voluntary freeze does not prevent entries, annotations or cancellations of any kind that come from a judicial order, and does not affect transactions already registered.
