In short: Yes, an American can work for a Guatemalan employer, but it is a regulated exception, not an open market. The Código de Trabajo (Art. 13) requires every employer to keep at least 90% Guatemalan workers, earning at least 85% of the payroll. The work permit regulation (Acuerdo Gubernativo 178-2025) lists residency in Guatemala among the permit requirements, while its document lists also accept a residency application in progress; the text does not settle which governs. The English-language ads we read on 24 September 2026 were for bilingual call centers, interpreting and teaching. The call-center and interpreting ads paid Q5,500 to Q8,244 a month (≈US$720–1,080). The non-agricultural minimum wage in the department of Guatemala is Q4,002.28 a month (Q3,816.90 elsewhere). Remote work for a US employer is a different question with its own residency route.

The legal rules come from the Código de Trabajo and the work permit regulation. The pay figures come from job ads live on Computrabajo on 24 September 2026. Gate 1: the 90% rule (Código de Trabajo, Art. 13)

Article 13 opens: “Se prohíbe a los patronos emplear menos de un noventa por ciento de trabajadores guatemaltecos y pagar a éstos menos del ochenta y cinco por ciento del total de los salarios que en sus respectivas empresas se devenguen, salvo lo que sobre el particular establezcan leyes especiales.”

In plain terms: at least 90% of an employer’s workers must be Guatemalan, and they must receive at least 85% of the total wages, unless a special law says otherwise. The same article adds:

  • Small employers: where the total workforce is five or fewer, four of them must be Guatemalan.
  • Senior roles are outside the count: the rule does not apply to “gerentes directores, administradores, superintendentes y jefes generales de las empresas”.
  • The Executive, through MINTRAB, can adjust the proportions by reasoned agreement. It can lower both by up to ten per cent each, for up to five years per company, for example where Guatemala lacks technicians in an activity. It can also raise them.

What it means for you: an employer who hires you uses up part of a limited foreign quota, unless you are hired as one of the managers the article exempts.

Gate 2: residency before the work permit

The work permit is issued by the Ministerio de Trabajo (MINTRAB) under Acuerdo Gubernativo 178-2025 (signed 29 September 2025), which replaced the 2003 regulation. Three articles decide who needs it, and the same regulation is two-sided on when:

  • Scope (Art. 1): permits for foreigners who “soliciten permiso de trabajo para prestar sus servicios a un empleador del sector privado”.
  • Who applies (Art. 3): foreigners “que se encuentren de forma regular en el país para laborar en relación de dependencia deberán solicitar autorización”.
  • Residency (Art. 5, requisitos numeral 4): “Poseer residencia permanente y/o temporal en Guatemala, de la persona extranjera a contratar.” Art. 7 (requisitos generales, numeral 3) says the same.
  • But a pending residency file is also listed (Art. 5, documents numeral 3): “Constancia de expediente en trámite extendida por el Instituto Guatemalteco de Migración, cuando la persona extranjera a contratar cuente con una solicitud de residencia en trámite”. Art. 7’s document list (numeral 3) likewise accepts proof that the residency file has been filed.

The requirement lists ask for residency; the document lists of the same articles contemplate a residency that is still in progress. The text does not settle which governs, and this page does not pick. What is clear: a job offer alone does not let you start work, and both an IGM residency file and a MINTRAB permit are involved. The Código de Migración (Art. 26) defines a migrant worker as any foreigner “que realice actividades remuneradas en territorio nacional”. The test is being paid for activity in Guatemala.

What the English-language jobs pay: ads live on 24 September 2026

We read the bilingual job ads on Computrabajo Guatemala on 24 September 2026. These are the ones that published pay:

What the ads say about foreigners. None mentions sponsoring a foreign worker’s permit or residency. The two interpreter ads require applicants to live in Guatemala.

Against the minimum wage

The 2026 minimum wage (Acuerdo Gubernativo 256-2025, as published by the state news agency AGN) for non-agricultural work in circunscripción económica C1, the department of Guatemala, is Q131.58 a day, Q4,002.28 a month. It is paid plus the bonificación incentivo of Decreto 78-89. The call-center pay above sits about 37–50% over that monthly figure. The C2 (rest of the country) non-agricultural figure is Q3,816.90 a month. Our salaries page has the other sectors.

Teaching English

Working remotely for a US employer

This is a different legal question from taking a Guatemalan job. On immigration status:

  • We found no Guatemalan instrument that addresses ordinary online work for a foreign employer on a tourist stamp.
  • IGM’s Reglamento de Residencias (Acuerdo IGM-016-2025) created a residency for a “trabajador migrante con empleador extranjero”, with a minimum foreign income of US$2,000 a month (US$3,000 with dependants).

Your realistic routes, in order

  1. Keep a US (or other foreign) employer and apply for the foreign-employer worker residency.
  2. A senior, technical or managerial role with a Guatemalan employer. The Art. 13 quota exempts managers, and a shortage of Guatemalan technicians is one of the stated grounds for relaxing it.
  3. Bilingual call-center or interpreting work, paying Q5,500–Q8,244 in the ads we read. Plan the residency and permit files before you accept.
