What is foreigner marriage in Guatemala
Guatemalan law allows two foreigners to marry without either being a resident or citizen. This makes Guatemala a popular destination for destination weddings (especially Antigua, Lake Atitlan, Tikal) and for couples wanting a faster or more flexible process than their home countries offer.
The marriage is performed by a Guatemalan public notary (the most practical option for foreigners) and registered with RENAP. Once apostilled at MINEX, the marriage certificate is valid in the 124 Hague Convention countries — including the US, Spain, Italy, Mexico, Canada, UK, Germany.
Unlike marriage between Guatemalans, foreigners have additional requirements: mandatory marital capitulaciones, criminal background check, and sworn translations of all non-Spanish documentation.
Requirements per person
Each of the two spouses-to-be must present:
- Valid passport (not a national ID — only international passport)
- Single status certificate (acta de solteria) from country of origin, apostilled there and translated into Spanish by a Guatemala-registered sworn translator
- Birth certificate apostilled and translated
- Medical certificate issued in Guatemala (lab or licensed physician, Q150-300)
- Criminal background check from country of origin apostilled and translated
- Valid entry stamp in passport (tourist visa or CA-4)
- If divorced: divorce decree apostilled and translated
- If widowed: prior spouses death certificate apostilled and translated
- 2 witnesses with valid ID or passport (not direct family)
Additional for the couple:

Step-by-step
Gather documents in country of origin (4-8 weeks before). Request single status certificate, birth certificate, criminal background. Each document MUST be apostilled in the issuing country (not in Guatemala). In the US: state Secretary of State of issuing state. In Spain: Ministerio de Justicia. In Mexico: SRE.
Translate documents to Spanish in Guatemala. Only Guatemala-registered sworn translators are accepted. Cost: Q100-200 per document. Find translators at the Colegio de Traductores e Interpretes. Time: 3-7 days.
Hire a public notary. Get 2-3 quotes — fees vary Q500-3000 depending on complexity and location. The notary handles everything: document review, capitulaciones, ceremony, and RENAP registration. Recommended: notaries with destination wedding experience (especially in Antigua).
Medical exam in Guatemala. Any recognized lab issues a marriage fitness certificate. Q150-300 per person. Validity: 30 days.
Sign marital capitulaciones (notarial deed). The notary drafts the document where both explicitly choose: community of acquests, absolute separation, or absolute community of property. For foreigners this step is mandatory.
Ceremony before the notary. Can be anywhere — notarys office, hotel, finca, restaurant. Duration: 30-60 minutes. Minimum attendance: both spouses + 2 witnesses + notary.
Notary registers the marriage with RENAP. Has 15 legal days from ceremony. Cost: Q15. The registration generates the official Marriage Record (Partida de Matrimonio).
Request marriage certification at RENAP. Once registered, you can request certifications (Q15 each). Request at least 2-3 originals — you will need one to apostille and another for your home country.

Common errors
We arrived in Guatemala without apostilling documents in our home country
Fatal error. Foreign documents MUST be apostilled in the issuing country before traveling. Guatemala CANNOT apostille documents issued by other countries. If you arrive without apostilles, you have 2 options: (1) return home to apostille, or (2) process through your countrys consulate in Guatemala (slower and more expensive). Always apostille BEFORE traveling.
The single status certificate is expired
Most single status certificates are valid for 3-6 months from issuance. If yours is over 6 months when you marry, the notary can reject it. Request a fresh certificate from your country (some countries allow request by mail or online from Guatemala via consulate).
The translator is not registered as sworn
RENAP and the notary only accept translations from sworn translators registered in the official Guatemalan system. Translations from commercial offices, online translators, or yourself are NOT valid. Verify the translators registration at the Colegio de Traductores e Interpretes before paying.
We did not sign marital capitulaciones
For foreigners, capitulaciones are MANDATORY. If the notary omitted them, RENAP will reject the registration. The only fix is to sign post-marital capitulaciones — additional process taking 2-3 weeks and costing Q500-1500 more. Verify your notary includes this step before signing the contract.
For foreign citizens: additional context
Destination weddings in Antigua and Atitlan. Antigua Guatemala is a popular destination for foreign couples — temperate climate, colonial architecture, tourist infrastructure. Hotels like Casa Santo Domingo, Porta Hotel Antigua, and Casa Palopo at Lake Atitlan have packages that include the notary and logistics. Full-package cost: USD 2,000-15,000.
Difference when one spouse is Guatemalan. If one spouse is Guatemalan, requirements are reduced: the Guatemalan only needs DPI, RENAP birth certification (less than 3 months old), and medical certificate. The foreign spouse keeps the requirements described above. Capitulaciones remain recommended but not strictly mandatory.
Visa implications. Marrying in Guatemala does NOT grant automatic residency. You must apply for residency separately — see Guatemala residency. Typically, the Guatemalan spouse can sponsor a resident visa for the foreign spouse (IGM process, 6-12 months).
International recognition. Your marriage is valid in any country recognizing the Hague Convention apostille. To register it in the US, present the apostilled RENAP certification at your states vital records office (some states require additional translation). For Spain, register at the consulate. For Italy/Germany, register at the local civil registry.
For US citizens specifically. The US does not have a centralized marriage registry — your marriage is recognized as valid abroad without re-registration. However, for federal purposes (immigration, taxes, social security), present the apostilled RENAP certification with a certified English translation. USCIS accepts this for spousal visa petitions (I-130).
