- US Court issues letter rogatory in Hague format (USM-94)
- US Dept. of State → MINEX Guatemala (Central Authority)
- MINEX → Supreme Court of Justice (CSJ)
- CSJ → competent Guatemalan court → executes → returns
International letters rogatory are the official judicial cooperation mechanism between Guatemalan courts and courts of other countries — primarily the United States due to the massive Guatemalan diaspora. They serve to notify defendants, summon witnesses, take depositions, execute attachments and serve legal process across borders. Guatemala acceded to the Hague Service Convention in 2017, which significantly accelerated the process vs. traditional consular route.
Quick summary: To send US→GT letter rogatory via Hague Convention (preferred): US court issues Hague format → US State Dept. → MINEX → GT Supreme Court → Guatemalan court. Time: 60-180 days. Cost: variable + translation + MINEX apostille (Q40-Q50). US judgments NOT automatically enforceable in GT — need homologation before CSJ.
Information verified May 2026.

Requirements for letter rogatory USA → Guatemala via Hague
- Original US court document — order, complaint, summons, subpoena, etc.
- Form USM-94 (US Marshal Service form) or equivalent Hague
- Apostille from US issuing state (Secretary of State where court issued)
- Spanish translation by sworn translator (can be in USA or in Guatemala — some GT lawyers prefer GT translation)
- Complete data of recipient in Guatemala: name, DPI/passport if known, current verifiable address
- Identification of US sending Central Authority — generally Department of State or designated process service
- US fees payment (varies by court and service, $30-$200)
- Contact data of US lawyer who can receive the result
Step by step (USA → Guatemala via Hague)
- US court prepares letter rogatory — generally with assistance of case lawyer. Must use Hague format (USM-94).
- US document apostille — Secretary of State of issuing state places apostille. $20-$50 by state.
- Spanish translation — can be done in USA by certified translator or in Guatemala by sworn translator. MANDATORY.
- Send to Guatemala Central Authority — US State Department or designated service (USA Process Servers International, etc.) sends package to MINEX (Guatemala Foreign Ministry).
- MINEX receives and forwards — sends it to Supreme Court of Justice (CSJ) of Guatemala.
- CSJ designates competent court — generally court of recipient’s address (notification) or place of act (deposition).
- Court executes the act — notifies recipient, summons witness, etc. If recipient locatable and cooperative: fast. If hides address: slow (search, edicts).
- Compliance certificate — court issues certificate certifying actions taken.
- Return via same route — Court → CSJ → MINEX → US State Dept. → requesting US court.
- (If apostille needed) — to use compliance certificate in USA, MINEX apostilles it (Q40-Q50) and is valid under Hague.

Common mistakes
- Forgetting US document apostille — without apostille, MINEX rejects the letter rogatory and you must start over. Months lost.
- Not translating to Spanish — every document must go translated. Software translations (Google Translate) NOT accepted — must be by sworn translator.
- Incorrect recipient data in GT — if address is wrong or name has errors, court cannot execute. Verify data before sending (RENAP search if has DPI).
- Expecting US judgment to be automatic in GT — US judgments NOT enforceable in GT without prior homologation before Supreme Court of Justice. Additional process of 6-12 months and Q5,000-Q15,000.
Common use cases
Case 1: US divorce lawsuit, spouse in Guatemala
- US court issues letter rogatory to notify spouse in GT of lawsuit
- Via Hague: 60-90 days
- Once notified, case continues in USA per state law
- For US judgment to have effect in GT (RENAP recording, GT asset division), must be homologated at CSJ afterwards
Case 2: Deposition for US case
- US lawyer needs testimony from witness in Guatemala
- Via Hague: formal request to CSJ → court designation → witness summoned to GT court
- Possible via videoconference with notary or judge presence in GT
- Alternative: voluntary consent deposition at US consulate in GT (if witness cooperates) — faster
Case 3: Process service to GT company in US lawsuit
- Guatemalan company sued in USA
- Via Hague to serve documents at company’s GT address
- Once notified, GT company must defend in USA or suffer default
- Common: hire US lawyer for defense or request jurisdictional protection
Case 4: Recognition of US support judgment in GT
- Mother with US child support judgment
- Father returns to Guatemala
- To enforce in GT: US judgment homologation before CSJ + apremio corporal in GT
- Time: 6-12 months homologation + 30-60 days apremio
- Alternative: new lawsuit in GT (may be faster)
Diaspora — from the USA processing letter rogatory to Guatemala
If you live in the USA and need to coordinate letter rogatory from there:
- Work with US lawyer specialized in international law (not just any lawyer)
- Verify if Hague applies to your US state and to type of act
- Consider hiring Guatemalan lawyer to accelerate and provide local follow-up
- Documentation: original US court order + apostille + sworn Spanish translation + GT recipient data
- International service: USA Process Servers International, ABC Legal, or similar service to channel
- US deadlines: if your US case has deadlines, calculate MINIMUM 90-120 days for typical execution
- Result: GT court certificate comes apostilled by MINEX and is presentable in US court under Hague
Diaspora tip: For repetitive cases (US company with many services to GT companies), establish relationship with a GT lawyer who can handle letters rogatory as regular practice — deadlines drop significantly with established relationships.
